These Terms of Use ("Terms") govern your use of the Scanz Application (the "App"), a mobile application provided by Scanz Automotive, LLC (d/b/a "Scanz"), and the V-Link OBDII Bluetooth device (the "V-Link") that connects to your vehicle and the App to provide vehicle diagnostic insights. These Terms also apply to data insights shared with your selected Preferred Store (e.g., a dealership) through the App. By downloading, installing, or using the App or V-Link, you agree to these Terms and our Privacy Statement. If you do not agree, you may not use the App or V-Link.
You must be at least 18 years old to create an account or use the App. The App is not designed for children under 13, and we do not knowingly collect information from children under 13. If we learn we have inadvertently collected such information, we will delete it promptly. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You may select a Preferred Store in the App, and your account information (e.g., name, email, phone number) and vehicle data may be shared with that service center to support vehicle maintenance, as detailed in our Privacy Statement.
Your use of the App is governed by our Privacy Statement, which explains how we collect, use, and protect your information, including Customer Personal Information (e.g., name, email, phone number) and vehicle data. By using the App, you consent to the collection and use of your data as described in the Privacy Statement and agree to both these Terms and the Privacy Statement. We comply with applicable privacy laws, including the California Consumer Privacy Act (CCPA) and CAN-SPAM Act, and you are responsible for providing accurate consent for data collection via the V-Link and App.
Scanz retains all rights, title, and interest in and to all Scanz Data, including diagnostic, performance, and aggregated data derived from the App and V-Link. You retain ownership of your Customer Personal Information. By using the App, you grant Scanz a non-exclusive, worldwide, royalty-free, perpetual license to use, analyze, and aggregate Scanz Data (excluding personally identifiable information) for purposes including analytics, improvement of services, and research, as described in the Privacy Statement.
All content, trademarks, logos, software, and technology in the App and V-Link are the property of Scanz or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or otherwise exploit any part of the App or V-Link without our prior written consent.

The App provides insights based on data from your vehicle's OBD-II system through the V-Link. While we strive for accuracy, we do not guarantee that all vehicle issues will be detected, and some diagnostic codes or conditions may not be captured. The App's services, including data shared with your Preferred Store, are intended to support, not replace, professional automotive service and maintenance. You should always consult a licensed automotive professional for repair or safety concerns.
We strive to keep the App reliable, maintaining at least 99% uptime and responding to support requests within 24 hours during business days, subject to planned maintenance or unforeseen circumstances. We do not guarantee that the App or V-Link will always be available, error-free, or uninterrupted. We may modify, suspend, or discontinue features or services at any time without liability. We are not responsible for delays, failures, or problems caused by factors beyond our reasonable control.
You agree to indemnify, and at Scanz's option, defend, and hold harmless Scanz and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App or V-Link, including misuse of the V-Link or unauthorized sharing of Scanz Data, your violation of these Terms, or your violation of any rights of another.
The App, V-Link, and related services are provided 'as is' and 'as available' without any warranties of any kind, whether express, implied, or statutory. Scanz disclaims all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the fullest extent permitted by law, Scanz and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly. Scanz's total liability shall not exceed the amount you paid us, if any, for the App or V-Link in the twelve (12) months preceding the claim. These limitations apply whether the claims are based on warranty, contract, tort (including negligence), or any other legal theory, even if Scanz has been advised of the possibility of such damages. This limitation applies to all services, including data provided to your Preferred Store.
If a dispute arises between you and Scanz that cannot be resolved informally, the parties will first attempt mediation in the State of Utah. If mediation fails, the dispute will be resolved through binding arbitration in the State of Utah under the rules of the American Arbitration Association. Either party may bring an individual action in small claims court for disputes within its jurisdiction. All arbitration proceedings shall be confidential. You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or jury trial.
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles.
We may suspend or terminate your access to the App or V-Link at any time if we believe you have violated these Terms, misused the services, or engaged in unlawful activity. Upon termination, your right to use the App and V-Link will cease. We may delete your Customer Personal Information in accordance with applicable law and our Privacy Statement, but we may retain and use aggregated or anonymized Scanz Data for analytics, research, and other lawful purposes.
Scanz may update these Terms from time to time. If we make material changes, we will provide notice by updating the date at the top of this document and, when appropriate, through the App or by email. Your continued use of the App or V-Link after changes means you accept the updated Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
If Scanz does not enforce a right or provision under these Terms, that does not mean we waive our right to enforce it in the future.
These Terms, together with our Privacy Statement, constitute the entire agreement between you and Scanz regarding your use of the App and V-Link, and supersede any prior agreements.
